Welcome to Dry Ice 4 Farming (“we”, “us”, “our”), a trading division of Dry Ice International . These Terms and Conditions govern your access to and use of the website dryice4farming.co.za (the “Website”) and any purchase of goods made through it. By browsing the Website or placing an order, you agree to be bound by these Terms. If you do not agree, please do not use the Website.

Dry Ice 4 Farming supplies dry ice (solid carbon dioxide) and related products and packaging for agricultural applications, including but not limited to freeze-branding, borehole and refrigeration use, cold-chain transport, and general farm use.

2. Eligibility to Purchase

By placing an order you confirm that: – you are at least 18 years old, or are placing the order with the consent of a parent or guardian; – you are legally capable of entering into a binding contract; and – the information you provide during registration or checkout is accurate, current, and complete.

3. Products and Descriptions

We take reasonable care to ensure that product descriptions, weights, sizes, and images on the Website are accurate. However: – Dry ice is a perishable, sublimating product, and the quantity delivered may vary slightly from the quantity ordered due to natural sublimation between dispatch and delivery. – Images are for illustrative purposes and actual packaging may differ. – We reserve the right to correct any errors, inaccuracies, or omissions, and to change or update information at any time without prior notice.

4. Pricing and Payment

  • All prices are listed in South African Rand (ZAR) and, unless stated otherwise, are inclusive of VAT where applicable.
  • Prices exclude delivery charges unless stated, which will be calculated and displayed at checkout.
  • We reserve the right to change prices at any time, but changes will not affect orders already confirmed and paid for.
  • Payment must be made in full before dispatch, using the payment methods made available on the Website (e.g. EFT, credit/debit card, or approved account facilities). We use third-party payment gateways to process online payments and do not store your full card details.
  • Should a pricing error occur on the Website (for example, due to a technical fault), we reserve the right to cancel the order and refund any payment made, or to contact you to confirm whether you wish to proceed at the correct price.

5. Orders and Acceptance

  • Placing an order constitutes an offer to purchase, which we may accept or decline at our discretion (for example, where stock is unavailable, delivery is not feasible to your area, or we suspect fraudulent activity).
  • A contract is only formed once we confirm your order in writing (including by email or SMS) and payment has been received.
  • We reserve the right to limit order quantities, particularly for handling and safety reasons associated with dry ice.

6. Nature of the Product – Important Safety Notice

Dry ice is solid carbon dioxide at a temperature of approximately -78.5°C and requires careful handling. By purchasing from us, you acknowledge and agree that: – dry ice must never be handled with bare skin, ingested, or stored in a sealed or airtight container, as the build-up of CO₂ gas can cause the container to rupture or explode; – dry ice must be stored and transported in a well-ventilated area, out of reach of children and animals; – you are responsible for using appropriate protective equipment (such as insulated gloves) when handling dry ice; and – we are not liable for injury, loss, or damage arising from misuse, improper storage, or failure to follow the safety guidance provided with your order or available on the Website.

It is your responsibility to ensure that dry ice is used and applied appropriately for your intended purpose (e.g. freeze-branding), and we recommend seeking professional or veterinary guidance for agricultural procedures performed on livestock.

7. Delivery

Delivery of orders is governed by our separate Shipping Policy, which forms part of these Terms.

8. Returns and Refunds

Returns, cancellations, and refunds are governed by our separate Refund and Return Policy, which forms part of these Terms. Given the perishable nature of dry ice, certain restrictions apply.

9. Limitation of Liability

To the fullest extent permitted by law: – we shall not be liable for any indirect, incidental, or consequential loss or damage (including loss of profit, loss of livestock value, or business interruption) arising from the use, misuse, or inability to use our products or Website; – our total liability for any claim arising from a purchase shall not exceed the amount paid for the relevant order; and – nothing in these Terms limits or excludes liability that cannot lawfully be limited or excluded under South African law, including under the Consumer Protection Act 68 of 2008.

10. Intellectual Property

All content on the Website, including text, graphics, logos, and images, is owned by or licensed to us and may not be copied, reproduced, or used without our prior written consent.

11. Website Use

You agree not to: – use the Website for any unlawful purpose; – attempt to gain unauthorised access to our systems or data; or – interfere with the proper functioning of the Website.

We may suspend or terminate access to the Website at our discretion where these Terms are breached.

12. Privacy

Our collection and use of your personal information is governed by our Privacy Policy, which complies with the Protection of Personal Information Act 4 of 2013 (POPIA).

13. Force Majeure

We shall not be liable for any delay or failure to perform our obligations where this is caused by circumstances beyond our reasonable control, including but not limited to load shedding, transport strikes, extreme weather, or supply chain disruptions.

These Terms are governed by the laws of the Republic of South Africa. Any disputes arising from these Terms or your use of the Website shall be subject to the non-exclusive jurisdiction of the South African courts.
